General Terms and Conditions for Webinars

 

§ 1 Scope of Application

These General Terms and Conditions apply to all contracts concluded with Bitkom Servicegesellschaft mbH, Albrechtstr. 10, 10117 Berlin (hereinafter referred to as “Bitkom Services”) regarding webinars held in preparation for the event “AIDAQ” taking place on 22 & 23 September 2026 (hereinafter referred to as “Webinars”).

§ 2 Registration

(1) Registration for participation in a Webinar is possible online via the AIDAQ website.

(2) Registrations will be processed in the order in which they are received. If registration for the desired Webinar can be accepted, the participant will receive a registration confirmation by email. The registration confirmation will be sent no later than two weeks before the start of the Webinar, unless the participant’s registration was received at a later date.

(3) The participant is entitled to notify Bitkom Services of any changes to the registration details up to one week before the start of the Webinar.

§ 3 Organisation of the Event, Cancellation by Bitkom Services

(1) Participation in the Webinar requires the participant to have a computer with an internet connection. The participant is responsible for ensuring that the necessary technical requirements for participation are met.

(2) Bitkom Services will provide the participant with the access details in good time before the start of the Webinar. The access details must not be passed on to third parties or made publicly available.

(3) The Webinars are prepared and delivered by qualified speakers. However, the participant has no entitlement to the Webinar being hosted by the speaker announced on the AIDAQ website.

(4) Bitkom Services shall not be liable for the timeliness, accuracy or completeness of the Webinar materials or the Webinar content, unless this is due to intentional or grossly negligent conduct by Bitkom Services or its agents. Bitkom Services does not guarantee that the participant will achieve any specific outcome as a result of participating in the Webinar.

(5) Bitkom Services is entitled to cancel the Webinar due to the unavailability of the speaker or an insufficient number of participants, to reschedule it, or to amend the Webinar programme.

§ 4 Liability

(1) Bitkom Services shall be liable without limitation only in cases of intent and gross negligence.

(2) In cases of slight negligence, Bitkom Services shall only be liable if an obligation has been breached, the fulfilment of which is essential for achieving the purpose of the contract (“cardinal obligation”). Cardinal obligations are obligations whose fulfilment enables the proper performance of the contract in the first place and on compliance with which the contractual partner regularly relies and may reasonably rely. In such cases, liability shall be limited to the foreseeable damage typical for the contract. Liability for slight negligence shall otherwise be excluded.

(3) The above provisions shall also apply in favour of Bitkom Services’ employees and agents.

(4) The limitation period for claims by the participant shall be one year insofar as the commencement of the limitation period depends on the participant’s knowledge; in all other cases, the statutory provisions shall apply.

(5) Claims under the German Product Liability Act and liability for injury to life, body or health shall remain unaffected by paragraphs (1) to (4) above. Claims for damages based on intentional or grossly negligent conduct shall not be subject to the limitation under paragraph (4).

§ 5 Copyright

The Webinar materials are protected by copyright and may not, even in part, be reproduced or passed on to third parties without the prior written consent of Bitkom Services and the speaker. Recording the event, for example by means of audio or video recordings or in the form of transcripts, is not permitted and may result in legal action.

§ 6 Final Provisions

(1) Any ancillary agreements must be made in writing in order to be effective.

(2) Any conflicting terms and conditions of the participant are hereby rejected.

(3) For transactions with merchants, legal entities under public law or special funds under public law, the place of jurisdiction shall be Berlin.
